California Court Case: In re B. G.Bedrich G. fled Czechoslovakia in 1968 with his two children and entered the United States as a political refugee. After Bedrich died in 1969, the juvenile court took jurisdiction over the children and placed custody with foster parents in California. Their mother, a resident of Czechoslovakia, now seeks to recover custody of her children.
California Court Case: Andrea L. v. Superior CourtThe minors were declared wards of the court pursuant to section 300 based on an amended petition which, as sustained with respect to mother, alleged mother left the minors with maternal great-grandmother on July 31, 1996, without making provisions for the minors' care; mother has inflicted trauma on the minors by punishing them excessively with a belt
California Court Case: Adoption of ALEXANDER S.The issue presented is whether the Court of Appeal had jurisdiction to address claims arising from a petition to withdraw consent to adoption. The trial court had denied the natural mother's petition to withdraw consent and no appeal from that judgment was brought within the limitations period of the California Rules of Court. Thus, the judgment denying the petition to withdraw consent became final.
California Court Case: Adoption of KELSEY S.The primary question in this case is whether the father of a child born out of wedlock may properly be denied the right to withhold his consent to his child's adoption by third parties despite his diligent and legal attempts to obtain custody of his child and to rear it himself, and absent any showing of the father's unfitness as a parent.
California Court Case: In re JASMON O.MOSK, J. Jasmon O. is now seven and a half years old. She has resided with her foster parents, who wish to adopt her, since she was an infant of six months. Her natural father asserts that it is in Jasmon's best interests not to terminate his parental rights but to transfer Jasmon's custody to him.
California Court Case: Adoption of OUKESOn May 16, 1968, petitioners Larry Lee Moore and Kay Jewel Moore (husband and wife) filed a petition for the adoption of the twins, Andrea and Andrew Oukes, born on March 18, 1966, to appellant Donna Lee McGary Oukes and Jan Oukes, her husband. Kay Moore is Jan's sister and paternal aunt of the infants. Jan signed a formal consent to adoption of the twins by the petitioners on August 14, 1968.
California Court Case: C. V. C. v. THE SUPERIOR COURT OF SACRAMENTO COUNTYThis mandate proceeding poses novel questions as to the rights of prospective adoptive parents whose status is terminated by the placement agency's demand for the child's return -- whether the due process guarantee of the Fourteenth Amendment entitles the prospective parents to pre-termination notice and hearing; whether judicial review entails a de novo decision supported by the weight of the evidence or a narrower inquiry into the agency's abuse of discretion.
California Court Case: Adoption of BERMANAppellants, Eugene Blymyer and Carlotta Blymyer, appeal from (1) order of the San Mateo County Superior Court, and (2) Judgment of the Alameda County Superior Court. Questions Presented: 1. The court did not err in denying appellants' motion to set aside stepparent adoption. 2. The court did not err in denying the grandparents visitation rights with the grandchildren.
California Court Case: Adoption of MICHELLE T.This is an appeal by petitioners, Ralph and Alice B., age 71 and 55 years, respectively, from a judgment denying their petition for the independent adoption of T., a 2-year-old female child. They contend that the court abused its discretion as their petition was denied on the sole ground of their age, without consideration of other relevant factors and the overriding "best interest of the child."
California Court Case: Adoption of COFFEEJames' mother signed a written consent to his adoption by petitioner (Civ. Code, § 226.1, subd. (a)), which consent was filed January 31, 1975. On the same date, a report of the Los Angeles County Department of Adoptions was filed, recommending that the petition be granted provided the court found that the father's consent to the adoption was not necessary. (Civ. Code, § 227a.) The petition for adoption was heard June 12, 1975.
California Court Case: Guardianship of BABY BOY M.Appellants Paul and Carol Lavallee appeal from a judgment dismissing their petition (1) for the adoption of Baby Boy M.; (2) for appointment as his guardian; (3) for a decree declaring the child free from custody and control of his natural parents; and (4) for forfeiture of the natural parents' right to be appointed guardians of the child.
California Court Case: Adoption of CORY LYN MURRAYBy its judgment the trial court denied a petition for a stepparent adoption. William Michael Owens, the proposed adoptive stepparent and the petitioner below, appeals. The marriage of Carolyn R. Owens and Lawrence C. Murray, the natural parents of the minor, was dissolved in 1976. The judgment of dissolution of marriage awarded custody of the minor, born October 2, 1974, to the mother, granted the father the right to reasonable visitation and ordered him to pay child support.
