Colorado Adoption Court Cases

Colorado Court Case: Dunbar v. White
We will refer to plaintiffs in error as the Inheritance Tax Department, and to the defendant in error as the transferee. The defendant in error has not appeared in this court. Amici Curiae have filed a brief and participated in oral argument. They take the same position here with reference to the subject matter as was asserted by the defendant in error in the county court.


Colorado Court Case: Smith v. Welfare Department
This case involves a motion to set aside a consent to relinquishment and adoption of a baby girl given by the child's natural parents in the juvenile court of Denver. After hearing evidence for and against the motion, the trial court denied relief, and plaintiffs in error, the natural parents, bring this writ of error. The Smiths were married on April 25, 1958, in Seattle, Washington.


Colorado Court Case: In re Petition of S.O. 795
This is an appeal of a judgment of the Denver Juvenile Court denying a natural father's motion to set aside a stepparent adoption of his son by the husband of the child's mother. n1 The appellant sought to set aside this stepparent adoption on the basis that his consent authorizing the adoption of his child was invalid because it was induced by an unenforceable promise that he could continue to have visitation rights with respect to his child.


Colorado Court Case: Matter of Trust Created by Belgard
Respondent, Robert Johnson, appeals a judgment of the probate court which construed the trust created by his mother to exclude his adopted wife as a remainderman. We affirm. Settlor created an express trust in Illinois in 1956 (the Belgard Trust). After her death and the death of her husband, respondent received the net income from the trust as lifetime beneficiary.


Colorado Court Case: Adoption of T.K.J.
Petitioners, G.K. and L.J., appeal the judgment which dismissed their petitions seeking the adoption of two children, T.K.J. and K.A.K., for lack of jurisdiction. We affirm. Petitioners live together as same-sex domestic companions. Each is the natural mother of one of the two children who are the subject of the petition. Each petitioner sought a "co-parent" adoption decree that would, in effect, grant her the rights and duties associated with a "stepparent adoption" for the other petitioner's child, while retaining her parental rights over her natural child.


Colorado Court Case: In re the Petition of S.O.
This is a stepparent adoption proceeding in which the trial court, preliminarily to the consideration of the other issues presented, determined that S.M.O., the child, was available for adoption under § 19-5-203(1)(d)(II), C.R.S. (1996 Cum. Supp.) because C.V.O., the child's natural father, had failed, without reasonable cause, to provide reasonable support to the child for a period of one year or more.


Colorado Court Case: In the Matter of Catholic Charities
R.F. (father) appeals from a juvenile court judgment terminating the parent-child legal relationship between him and his daughter, C.C.G., pursuant to § 19-5-105, C.R.S. (1996 Cum. Supp.). We reverse and remand for further proceedings. Shortly after the child was born in May 1995, the mother initiated a proceeding pursuant to § 19-5-101, et seq., C.R.S. (1996 Cum. Supp.) for voluntary relinquishment of her parental rights.


Colorado Court Case: In re I.R.D.
Opinion by JUDGE METZGER S.C.R. (father) appeals the judgment terminating his parent-child legal relationship with his son, G.L.R. We affirm. G.L.R. was born in Missouri on May 26, 1992. Although father has never disclaimed paternity, he refused to place his name on the birth certificate, fearing that he might later be held financially responsible for the child.


Colorado Court Case: People in the matter of A.L.B.
J.W.R. (father) appeals from the judgment terminating the parent-child legal relationship with his son, B.L.B. We affirm. Mother and father were not married. Prior to the child's birth, they decided that they were not ready to assume the responsibilities of parenthood. Accordingly, both parents requested adoption and relinquishment counseling from Adoptions:
