Suzi, you might be able to use all your PTO then. Depending on how quickly you match, you may have time at least to be able to cover some of it. I know for my situation, if I don't match before January, I'll be using my PTO for 2008 to cover the other 6 weeks I don't get paid.

Thanks for the replies. I checked into it more today and there is no chance of me getting to use any of my sick leave. My employer (sadly, a hospital system) doesn't even provide a "maternity leave" except for the federally mandated FMLA. Our sick leave is separate from our PTO, and they won't even allow you to use it if your child is sick and you have to stay home from work to care for them. Since we haven't had to deal with this before, I never even bothered to look into the policies when I was looking for jobs. Next time, I will definitely be looking into it!

I believe use of sick time is up to your employer. FMLA doesn't guarantee any kind of pay -- just the 12 weeks unpaid leave with job guarantee. My company doesn't allow use of sick time, but I do get a week of paid leave for every year I have been with the company. So I'd get 6 weeks paid and then I can use my vacation time to make up the remaining 6. My husband only gets 1 week paid, but he can use the 12 weeks too.

Suzi - where I worked during our first adoption, our vacation and sick time was all combined so I was able to take it. That is how it is where I work now too, which is great. I already have 4 weeks saved up. Do you all really have to be sick to take sick time? Even here when sick time used to be separate (and you couldn't carry it over), you did not have to technically be sick to use it. I would talk with HR about it and see what the actual policy is. I hope you get it worked out. It is unfair mothers who give birth get 6-8 weeks off with pay as a disability. They need a few weeks to recover, but part of that time is bonding. I had a friend who donated me a week the first time because she thought it was unfair I got no paid time off.

I just found out that my employer is going to refuse to let me use my accumulated sick time when we are placed with a baby because I am not actually giving birth to the baby myself. I am still allotted the FMLA's unpaid 12 weeks, but since its an adoption they are refusing to pay my sick time. Its frustrating because if I had given birth to the child myself, I would be allowed to use my sick pay. Has anyone else had this problem? I am still trying to figure out if this is legal or not or if this is some sort of discrimination...I would love to hear from anyone who knows anything about this!
