you would have to get a good attorney. i just adopted my nephew. i had him put in the system first. its more easy. they will then take birth parents to court to surrender their rights. then you can apply to adopt. it took my husband and i 1 year in total

My husband and I currently have temporary custody of our neice. Our situation will probably not be permanent. Depending on the state you live in you may become a family foster parent through the social service program. That way your nephew can be with you until his parents either sign away their rights or they are removed from them. Once their rights have been terminated you can then begin the process of adoption. If you become his foster parent his social worker should be able to guide you through the process. Hope this helps and good luck!

How is the proper way to legally adopt my nephew so he is not put into the system?
