Father is in Jail
This is a much more common situation than you would first think – American Adoptions has a lot of experience handling this scenario. Incarcerated birth fathers are rarely, if ever, able to assert their parental rights because of the fact they are in jail, and are considered to have forsaken their rights as a citizen by committing the crime they did. Moreover, courts often view jail time and the criminal activity that led the father to there as indicative of his ability to offer a positive and functional environment to the child. As with all of adoption, the process varies from state to state, but typically, his rights are terminated in the event that the baby’s father is in jail.
