5 FAQs for Preventing an Adoption Disruption

Adoption disruption is one of the biggest concerns families have during the adoption process.

Expectant parents must always have the right to change their minds, and no agency can remove that possibility. But disruptions are not purely random.

How an agency screens situations, supports expectant parents, manages legal requirements, and structures financial risk can all influence whether an adoption moves forward or falls through.

These five questions explain what families should understand about disruption risk and how the right agency structure can help reduce it.

Most families who experience disruption later say there were warning signs they did not know to look for.

FAQ 1: What Causes Most Adoption Disruptions?

Some adoption disruptions occur because an expectant parent decides not to place, and that decision must always be respected.

However, many disruptions are influenced by factors earlier in the process that relate to how an adoption situation was handled.

Common contributors include:

• Limited or rushed screening of adoption situations.
• Inadequate counseling or ongoing support for expectant parents.
• Pressure to match quickly due to limited outreach.
• Licensing or legal readiness issues discovered late.
• Financial structures that encourage moving forward despite concerns.

In many cases, families later realize that warning signs were present but not recognized at the time.

FAQ 2: How Does Agency Screening and Support Affect Disruption Risk?

Screening and counseling cannot remove an expectant parent’s right to change their mind, but they play a major role in helping that parent make a stable, informed decision.

Agencies with licensed social workers and experienced staff are better able to:

• Provide ongoing counseling instead of a single intake conversation.
• Help expectant parents fully explore all available options.
• Identify uncertainty or outside pressure early.
• Support voluntary and informed decisions.

When emotional support is limited or treated as a formality, uncertainty has more room to grow.

FAQ 3: How Do Marketing and Wait Times Affect Disruption Risk?

Marketing affects disruption risk more than many families realize.

Agencies with limited outreach often struggle to find consistent adoption opportunities. This can lead to long waits and pressure to move forward simply to stop waiting.

Families sometimes accept situations that feel unstable because opportunities are scarce.

Agencies with strong marketing reach are better able to:

• Present thoroughly vetted adoption opportunities.
• Avoid matching out of urgency.
• Allow time for proper screening and counseling.

Visibility creates options. Options reduce pressure. Reduced pressure lowers disruption risk.

FAQ 4: Can Licensing or Legal Structure Cause an Adoption to Fall Through?

Yes. Licensing and legal structure play a major role in whether an adoption can legally proceed.

Adoption laws are governed at the state level. When an adoption involves more than one state, the agency must be properly licensed and prepared to manage the process.

Disruption risk increases when:

• An agency operates nationally but is licensed in only a few states.
• Advertising occurs in states where the agency is not licensed.
• Cross-state legal requirements are handled incorrectly.
• Legal authority is transferred to outside partners late in the process.

In these situations, an adoption may be delayed, transferred, or even denied despite everyone wanting the process to continue.

FAQ 5: If an Adoption Disruption Happens, Who Absorbs the Cost?

Even when a disruption cannot be prevented, how financial risk is handled matters.

In many adoption programs, families absorb all financial losses after a disruption. This can make it difficult to continue the adoption journey.

A lower upfront cost does not always reduce the overall financial risk if it shifts the burden entirely onto the family.

How We Guide Families and Prevent Unnecessary Risk

At American Adoptions, these protections are not optional services. They are the foundation of how our program is built.

Our adoption process is designed to reduce disruption risk by providing:

National marketing outreach that creates consistent adoption opportunities.
Licensed social workers who support expectant mothers throughout the process.
Multi-state licensing and legal expertise to safely manage adoptions across the country.
Financial protection programs that help families continue their journey if a disruption occurs.

These systems work together to guide families through the most complex parts of adoption with greater stability and support.

Many families begin the adoption process unsure of what questions to ask or what risks to watch for. Our team helps families understand those factors early so they can move forward with greater clarity and confidence.

Frequently Asked Questions

Do we need to retain our own attorney?

No, American Adoptions has established relationships with some of the best adoption attorneys in the nation. Because adoption laws vary from state to state and between counties, it is important to utilize the services of an adoption attorney who specializes in the state where the adoption will finalize, which is unknown until you match with an expectant mother. You have the right to retain your own attorney, but doing so may be an additional, unnecessary expense.

Can we choose the gender of our baby?

American Adoptions does not allow gender specificity in adoption. Any family who wishes to be gender-specific in their adoption should contact us at 1-800-ADOPTION and ask about the possibility of an exception waiver before taking any other steps toward adoption with our agency. Any families who do receive an exception to be gender-specific may also incur an additional fee, which helps cover the additional advertising costs of such a request.

Please note that gender specificity will likely increase your wait time significantly.
